billionaire Elon Musk has been ordered to appear in court to resolve issues related to author Ashley St. Clair’s child custody lawsuit.
Musk, 53, is scheduled to appear on May 29, according to People . Musk’s lawyers will debate whether the billionaire needs a paternity test, Ashley St. Clair’s request for sole custody of the child, and the couple’s child support agreement. New York Supreme Court Justice Jeffrey H. Pearlman is overseeing the case.
Karen B. Rosenthal, Ashley St. Clair’s attorney, said Musk has not yet responded to the court’s request. Musk is represented by an attorney in New York City, where Ashley St. Clair lives and filed the lawsuit. “He has prolonged this and caused unnecessary distress. We have no one to speak to in a dignified manner,” Rosenthal said.

St. Clair sued Musk for custody of their son on February 21. In the filing, the author said that RSC – their son – was born in September 2024. She asserted that Musk was not present when RSC was born and “only met the child three times, did not participate in the care and upbringing of the child”. St. Clair also asked to determine the paternity.
The writer provided extensive information about their “romantic relationship,” which began in February 2023. Musk “admitted to being the father” in multiple messages, after RSC was born.
St. Clair said Musk first met his son on September 21, 2024, and spent two hours with him, then an hour the next day. Musk last visited the RSC on November 30, 2024, for 30 minutes.

He welcomed his first child with his first wife, Justine Wilson, in 2002, but the baby died at 10 weeks old. The couple had five more children before divorcing in 2008. He had three more children after dating singer Grimes in 2018. Elon Musk is dating Neuralink startup CEO Shivon Zilis . They have four children together, including twins born a few weeks before Grimes welcomed her third child. Zilis announced on February 28 that she is expecting her fourth child with Musk.
On X on February 20, Grimes posted a plea for Elon Musk to respond to her contact because one of their children had serious health problems. The American billionaire has not responded to this information.
